FTC ISSUES FINAL TELEMARKETING SALES RULE AMENDMENTS REGARDING PRERECORDED CALLS The Federal Trade Commission today announced two amendments to the Telemarketing Sales Rule (TSR). One will expressly bar telemarketing calls that deliver prerecorded messages, unless a consumer previously has agreed to accept such calls from the seller. The other related technical amendment modifies the TSR's method of calculating the maximum permissible level of "call abandonment." read more
LOAN MODIFICATION PROGRAM FOR DISTRESSED INDYMAC MORTGAGE LOANS IndyMac Federal Bank, FSB ("Indymac Federal") will implement a new program to systematically modify troubled mortgages. The program is designed to achieve affordable and sustainable mortgage payments for borrowers and increase the value of distressed mortgages by rehabilitating them into performing loans. This in turn will maximize value for the FDIC, as well as improve returns to the creditors of the former IndyMac Bank and to investors in those mortgages. The new program will help IndyMac Federal improve its mortgage portfolio and servicing by modifying troubled mortgages, where appropriate, into performing mortgages. read more

FTC TO HOST WORKSHOP TO EXPLORE CONSUMER PROTECTION AND PRIVACY IMPLICATIONS OF RADIO FREQUENCY IDENTIFICATION APPLICATIONS The Federal Trade Commission will host a "Transatlantic RFID Workshop on Consumer Privacy and Data Security" on September 23, 2008, to explore emerging applications of radio frequency identification technology and their implications for consumer protection policy. The workshop will bring together industry representatives, government officials, and consumer advocates from Europe and the United States to discuss security and privacy concerns associated with RFID technology. The workshop, which is free and open to the public, will be held at the Federal Trade Commission Conference Center, 601 New Jersey Avenue, N.W.,Washington, DC 20001. FIRST DATA REPORTS SECOND QUARTER 2008 REVENUE GROWTH OF 10% First Data Corp. today reported its financial results for the second quarter of 2008. Consolidated revenues were up 10% to $2.2 billion.
